If there is a conflict between the Terms of Service and this Privacy Policy concerning our collection, use, or disclosure of personal information, this Privacy Policy controls with respect to those privacy practices.

Sources of Personal Information

We may collect personal information from:

  • You, including when you browse the Services, create an account, place or attempt to place an order, make a return, submit a review, join a promotion, subscribe to communications, or contact us;
  • Your device and browser, through cookies, pixels, tags, local storage, and similar technologies;
  • Shopify and our service providers, including payment processors, fulfillment and shipping providers, customer-support providers, security and fraud-prevention providers, analytics providers, and marketing platforms;
  • Advertising and business partners, including social-media platforms, affiliate partners, and companies that help us understand or reach customers; and
  • Other lawful sources, such as public sources, referral partners, and information you make available through social media or other third-party platforms.

How We Use Personal Information

We may use personal information to:

  • Provide and fulfill the Services, including processing payments, fulfilling and shipping orders, managing accounts, providing order updates, processing returns and exchanges, and enabling reviews or other requested features;
  • Personalize and improve the Services, including remembering preferences, recommending products, understanding how the Services are used, developing new offerings, and improving website performance and customer experience;
  • Communicate with you, including responding to questions, providing customer support, sending transactional notices, and maintaining our business relationship;
  • Market and advertise, including sending promotional emails or text messages where permitted, measuring campaigns, and displaying advertising that may be based on interactions with our Services or other websites;
  • Protect YEOUTH, customers, and others, including authenticating users, securing transactions and accounts, detecting and responding to suspected fraud, abuse, security incidents, or unlawful activity, and protecting health, safety, rights, and property;
  • Comply with law and enforce our rights, including responding to lawful requests, subpoenas, court orders, or regulatory inquiries; maintaining required records; conducting audits; resolving disputes; participating in legal proceedings; and enforcing our terms and policies; and
  • Complete business transactions, including evaluating or carrying out a merger, financing, acquisition, reorganization, bankruptcy, sale of assets, or similar transaction.

Where required by applicable law, we process personal information based on one or more recognized legal grounds, including performing a contract with you, complying with legal obligations, pursuing legitimate business interests, protecting vital interests, and obtaining your consent. Where processing is based on consent, you may withdraw that consent as permitted by law, without affecting processing that occurred before withdrawal.

Cookies and Similar Technologies

We and our service providers may use cookies, pixels, tags, local storage, software development kits, and similar technologies to:

  • Operate essential website and checkout functions;
  • Keep accounts and transactions secure;
  • Remember preferences and items in a cart;
  • Understand website traffic and interactions;
  • Diagnose errors and improve performance;
  • Measure the effectiveness of marketing; and
  • Support personalized or targeted advertising where permitted.

Some of these technologies may allow advertising or analytics partners to collect or receive information from the Services and other websites over time. Where required by law, we obtain consent before using nonessential technologies.

You may manage available choices through our cookie-preference tool and our data-sharing opt-out page. You may also be able to block or delete cookies through your browser settings, although doing so may affect the availability or functionality of parts of the Services.

Where required by applicable law, we recognize the Global Privacy Control signal as a request to opt out of the sale or sharing of personal information for the browser or device sending the signal. If we can associate that device with your Shopify account, Shopify may also apply the request to the account. To learn more, visit Global Privacy Control. Other than legally recognized opt-out preference signals, we do not respond to browser "Do Not Track" signals.

How We Disclose Personal Information

We may disclose personal information for legitimate business purposes to:

  • Shopify, which hosts and supports the ecommerce Services;
  • Service providers and contractors, including payment processors, order-fulfillment companies, shipping carriers, cloud-hosting providers, IT and security providers, fraud-prevention services, analytics providers, customer-support platforms, email and text-message providers, and professional advisers;
  • Advertising and marketing partners, including social-media platforms, advertising networks, analytics companies, affiliate partners, and companies that help us personalize or measure advertising;
  • Business and commercial partners, when necessary to provide a feature, promotion, integration, product, or service you request;
  • Our affiliates and companies under common ownership or control;
  • A successor or transaction participant, in connection with an actual or proposed merger, financing, acquisition, restructuring, bankruptcy, sale of assets, or similar corporate transaction;
  • Governmental, regulatory, legal, and safety recipients, when we reasonably believe disclosure is required or permitted by law, necessary to respond to valid legal process, or appropriate to protect rights, property, safety, customers, the public, or the Services; and
  • Other recipients at your direction or with your consent.

We do not sell personal information for money. However, certain disclosures of contact information, device identifiers, internet activity, commercial information, approximate location, or related inferences to advertising and analytics partners may be considered a "sale," "sharing," or use for "targeted advertising" under some state privacy laws, even when no money is exchanged. You may exercise an applicable opt-out right through our data-sharing opt-out page or a recognized opt-out preference signal as described above.

We do not knowingly sell or share the personal information of consumers under 16 years of age.

Relationship with Shopify

The Services are hosted by Shopify. Shopify collects and processes personal information about access to and use of the Services to provide and improve its platform and related services. Information submitted through the Services may be transmitted to Shopify and to service providers located in countries other than the country where you reside.

We may use Shopify features that combine information about interactions with our store, other merchants, and Shopify. In circumstances where Shopify determines the purposes and means of its own processing, Shopify is responsible for that processing and for responding to applicable requests concerning it.

For more information, review the Shopify Consumer Privacy Policy and the Shopify Privacy Portal.

Marketing Communications

You may unsubscribe from promotional emails at any time by using the unsubscribe link in the email. If you have consented to receive promotional text messages, you may opt out by following the instructions in the message, such as replying STOP. Message and data rates may apply.

Even after you opt out of promotional communications, we may continue to send nonpromotional messages, such as order confirmations, shipping updates, account notices, safety information, or responses to your requests.

Your Privacy Rights and Choices

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Request access to or confirmation of the personal information we process about you;
  • Request the categories and specific pieces of personal information we have collected about you;
  • Request correction of inaccurate personal information;
  • Request deletion of personal information;
  • Obtain a portable copy of certain personal information;
  • Opt out of the sale or sharing of personal information or its use for targeted advertising;
  • Limit certain uses or disclosures of sensitive personal information, where applicable;
  • Object to or request restriction of certain processing;
  • Withdraw consent where processing is based on consent;
  • Opt out of certain profiling or automated decision-making where required by law; and
  • Appeal our denial of a privacy-rights request where applicable.

These rights are not absolute. We may deny or limit a request as permitted by law, including when we cannot verify your identity, when an exception applies, or when we must retain information to complete a transaction, detect fraud, comply with law, establish or defend legal claims, or protect the rights of others.

How to Exercise Your Rights

You may submit a request by:

  • Using the privacy controls or request methods provided through the Services;
  • Visiting our data-sharing opt-out page; or
  • Emailing customerservice@yeouth.com with the subject line Privacy Request.

Please describe the right you wish to exercise and provide enough information for us to identify the relevant records and respond. We may request information reasonably necessary to verify your identity and authority. We will use verification information only for verification, fraud prevention, and compliance purposes.

You may designate an authorized agent to submit a request on your behalf where permitted by law. We may require proof that you authorized the agent and may ask you to verify your identity directly with us, unless applicable law provides otherwise.

We will not discriminate against you for exercising an applicable privacy right. We will respond within the period required by applicable law. If we deny a request and applicable law provides a right to appeal, you may appeal by replying to our decision or emailing customerservice@yeouth.com with the subject line Privacy Appeal and explaining the basis of your appeal.

Children's Data

The Services are intended for a general audience and are not directed to children under 13. We do not knowingly collect personal information online from children under 13. If you believe a child under 13 has provided personal information to us, please contact us so that we can review and, where appropriate, delete it.

We do not have actual knowledge that we sell or share, as those terms are defined by applicable law, personal information of consumers under 16 years of age.

Security

We use administrative, technical, and organizational safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

You are responsible for maintaining the confidentiality of account credentials and for notifying us if you suspect unauthorized access to your account. Please do not send sensitive or confidential information through an unsecured communication channel.

Retention

We retain personal information only for as long as reasonably necessary and proportionate for the purposes described in this Privacy Policy, including providing the Services, maintaining our relationship with you, administering accounts and transactions, satisfying operational needs, preventing fraud, resolving disputes, enforcing agreements, and complying with tax, accounting, recordkeeping, and other legal obligations.

The category-specific criteria in the table under Personal Information We Collect help determine the applicable period. We may retain information longer when required by law, subject to a legal hold, or reasonably necessary to establish, exercise, or defend legal claims. When personal information is no longer required, we take reasonable steps to delete, destroy, or deidentify it in accordance with our procedures and applicable law.

International Transfers

We and our service providers may transfer, store, and process personal information in the United States and other countries that may have data-protection laws different from those where you live.

Where applicable law requires a recognized transfer safeguard, we rely on appropriate mechanisms, such as adequacy decisions, the European Commission's Standard Contractual Clauses, the United Kingdom's International Data Transfer Agreement or Addendum, or another legally recognized mechanism.

Third-Party Websites and Services

The Services may link to websites, applications, social networks, or other platforms operated by third parties. Their privacy and security practices are governed by their own notices and terms, not this Privacy Policy. We do not control and are not responsible for the privacy, security, accuracy, or availability of third-party services.

Information posted in public or semi-public areas, including reviews or social-media platforms, may be visible to and used by others. Please use care before making information public.

Complaints

If you have a concern about our privacy practices, please contact us using the information below. Depending on where you live, you may also have the right to lodge a complaint with a data-protection, consumer-protection, or other regulatory authority.

Dispute Resolution and Class-Action Waiver

Disputes arising out of or relating to this Privacy Policy, our privacy practices, the Services, or products purchased through the Services are subject to the dispute-resolution provisions in our Terms of Service, which are incorporated here by reference. Those provisions include, to the fullest extent permitted by applicable law, an agreement to resolve covered disputes through binding individual arbitration and a waiver of participation in class, collective, consolidated, coordinated, mass, or representative actions.

Nothing in this Privacy Policy or the Terms of Service waives or limits a right or remedy that cannot lawfully be waived, including any applicable right to seek public injunctive relief, bring an eligible individual action in small claims court, or submit a complaint to a governmental or regulatory authority.

This section becomes effective only when YEOUTH adopts the corresponding counsel-approved dispute-resolution provisions in its Terms of Service and obtains legally sufficient assent.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes to our practices, technology, Services, or legal obligations. When we make changes, we will post the revised policy, update the "Last updated" date, and provide any additional notice or obtain any consent required by applicable law.

A material change to the dispute-resolution provisions will be governed by the notice, assent, and prospective-application requirements in the Terms of Service. We will not represent that a newly adopted dispute provision applies retroactively to an existing dispute unless applicable law and a valid prior agreement permit that result.
